PLCAA Statement of Lawful Commerce

Longshot Armory is engaged in the lawful commerce of firearms, ammunition, and related

products. All sales and transfers are conducted in strict compliance with applicable federal and

Utah law.

The parties acknowledge that the Protection of Lawful Commerce in Arms Act (“PLCAA”),

15 U.S.C. §§ 7901–7903, preempts certain causes of action against manufacturers, distributors,

dealers, and sellers of firearms and ammunition arising from the criminal or unlawful misuse of

such products by third parties.

Assumption of Risk

Firearms and ammunition are inherently dangerous products when used improperly or

unlawfully. By purchasing from Longshot Armory, you knowingly and voluntarily assume all risks

associated with the lawful or unlawful use, misuse, storage, transportation, modification, or

possession of firearms, ammunition, or related products after lawful sale or transfer.

Release of Liability

To the fullest extent permitted by Utah law, federal law, and the PLCAA, you expressly

release, waive, and discharge Longshot Armory and its owners, officers, employees, agents,

contractors, affiliates, successors, and assigns (collectively, the “Released Parties”) from any

and all claims, actions, damages, losses, liabilities, or causes of action, whether statutory, tort,

or otherwise, arising out of or relating to:

● The criminal, unlawful, negligent, or intentional misuse of firearms or ammunition by

you or any third party

● Acts or omissions of third parties following the lawful sale, transfer, or delivery of

products

● Your failure to comply with firearm safety practices or applicable laws

● Any harm resulting from products that function as designed and intended

Nothing in these Terms shall be construed to waive liability where such waiver is expressly

prohibited by law.

No Responsibility for Third-Party Acts

Longshot Armory does not assume, and expressly disclaims, any responsibility or liability for the

actions or omissions of third parties, including but not limited to subsequent purchasers,

transferees, users, or possessors of firearms or ammunition following a lawful sale or transfer.

Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any

and all claims, actions, damages, losses, liabilities, judgments, costs, and expenses (including

reasonable attorneys’ fees) arising out of or related to:

● Your purchase, possession, use, misuse, or transfer of products

● Any violation of federal, Utah, or local law

● Any allegation that would be barred, limited, or preempted under the PLCAA

This obligation survives the completion of any transaction.

Limitation of Liability

To the maximum extent permitted by Utah law and federal law, including the PLCAA, Longshot

Armory shall not be liable for any indirect, incidental, consequential, exemplary, or punitive

damages arising from or related to the lawful sale or transfer of firearms, ammunition, or related

products, or their subsequent use or misuse.

Construction and Intent

These Terms shall be interpreted and enforced to the fullest extent permitted by applicable law

and consistent with the intent and protections afforded by the Protection of Lawful Commerce

in Arms Act. Any ambiguity shall be resolved in favor of lawful commerce and statutory

immunity.
